The Supreme Court of Canada will hear a case about a First Nation's claim to title over a swath of Nootka Island.
The Nuchatlaht First Nation brought a claim for Aboriginal title to about 200 square kilometres of the island, which lies off the west coast of Vancouver Island.
The trial judge found the Nuchatlaht had established title over only portions of the claimed area.
The First Nation challenged the decision in the British Columbia Court of Appeal.
In April, the Court of Appeal found the trial judge used an "arbitrary boundary" to determine title.
A three-judge panel of the Appeal Court said the Nuchatlaht identified territory it exclusively occupied and used for hunting, fishing and gathering activities, and presented other evidence that established its "strong presence on or over the land claimed."

SeatGeek Canada is facing two more fines from the Ontario government for allegedly contravening a recent law capping the sale of event tickets at face value.
The province's consumer beware website shows the new fines issued to the ticket resale website earlier this month total $22,500 collectively.
The website says the first of the two fines amounts to $15,000 and is for allegedly making a ticket available for sale or facilitating a sale of a seat beyond the resale price limit.
The second fine is for $7,500 and is for allegedly failing to disclose the total price of a ticket when a seat was purchased from a primary seller.
The province and SeatGeek Canada did not immediately respond to questions about what events the fines stem from or whether the reseller will fight the penalties.
The province previously issued $25,000 in fines to the company in August for similar offences.

The federal government plans to spend $430 million over the next five years to help unions train a new generation of skilled trades workers.
Ottawa is opening applications today for access to the new pool of funding, most which comes through an expansion to the Union Training and Innovation Program.
The federal government says in a news release that unions and training providers will be able to apply for extra capital to expand their training facilities and other infrastructure starting next spring.
A separate application stream will temporarily boost federal contributions to help eligible organizations cover the cost of training equipment.
A third stream will fund unions' proposals for innovative ways to attract, recruit and support trainees before and throughout the apprenticeship process.
Nearly half of today's funding announcement is accounted for in a previous Liberal government pledge to spend $8 billion to recruit and train up to 100,000 new skilled trades workers in the next five years.
