B.C. billionaire's real estate firms allege 'pattern of misconduct' by CRA in tax row
Companies controlled by billionaire B.C. property developer Terry Hui allege that the Canada Revenue Agency has engaged in a "pattern of misconduct" in its attempts to collect on ballooning tax debts dating as far back as 2007.Â
Five companies within Hui's real estate development group are targeted in the audit by the CRA, including Adex Securities, One West Holdings, a B.C. numbered company and two Luxembourg-based shell companies.Â
The companies filed an application in Federal Court this month, claiming the government has wrongfully moved to collect on tax debts totalling nearly $330 million, most of which is accrued interest.Â
The application says the group is involved in capital-intensive real estate projects in Toronto, Vancouver and Calgary and the audit, initiated in 2013, focused on transactions that relied on Canada's tax treaty with Luxembourg.
The companies say in the application that they've received tax debt assessments this year, with Adex owing $45 million and interest of more than $65 million, while the two Luxembourg based companies owe together more than $92 million and $127 million in interest.Â
They want the court to stop the government from collecting on the debts until a related case filed earlier this year is concluded, while objecting to the CRA wanting $115 million security payment from Adex.
Requiring a payment that large and not allowing the company to defer will cause the real estate group to "lose significant capital that is currently being used to fund active development projects."Â
The application is one of at least three filed in Federal Court this year related to the dispute, where they claim that being forced to pay will cause "irreparable harm" and that no advance notice from the CRA means that they "could not have reasonably planned for a debt … of this magnitude."Â
The companies claim the revenue agency has exhibited a "pattern of misconduct," alleging its officers acted outside established policies and procedures and "without regard to the impact of their actions on taxpayer businesses."
Lawyers for the companies were not immediately available for comment, but Justin Kutyan with KPMG Law in Toronto told The Canadian Press earlier this year that the transactions in the case were similar to a tax structure upheld by the Supreme Court of Canada in 2021.Â
The court ruled 6-3 in favour of Alta Energy Luxembourg, which had claimed a tax exemption on a capital gain of more than $380 million under Canada's treaty with Luxembourg, described in the decision as being "well known as an international tax haven."Â
The court found in Alta's favour, ruling that Canadian tax authorities couldn't use anti-tax avoidance rules to "judicially amend or renegotiate a treaty."
The dissenting justices in the case, however, said "the federal government did not deliberately set out to create the conditions for unlimited tax avoidance by means of schemes" used by the company.Â
The dissenters wrote that "the court should not legitimize such blatantly abusive tax avoidance based on the view that Canada should have negotiated different treaty terms."
The CRA said it did not have a spokesperson available for an interview to comment on tax treaty abuse. Â

Toddler critically injured after car hit five kids, daycare worker in Oshawa, Ont.
Durham regional police say a two-year-old girl was critically injured when a car struck a group of young children and a daycare worker in Oshawa.
Acting Sgt. Nicholas Gluckstein says the daycare worker was on her daily walk with five children through a residential neighbourhood this morning when they were all struck by a car while crossing the street.
He says the two-year-old girl suffered life-threatening injuries and was taken to a local hospital before being rushed by air ambulance to a Toronto-area trauma centre.
The officer says police are "hoping for the best" but the girl's injuries are "very serious."
The four other children who were hit, ranging in age from three years to just seven months, were hospitalized with minor injuries, Gluckstein said, while the adult daycare worker suffered serious but non-life-threatening injuries.Â
Gluckstein says the driver of the car was heading south and making a left turn through an intersection controlled by two stop signs when they struck the six pedestrians.Â
"The person driving southbound, there are no stop signs for them to potentially stop and take a look around there. But five children and an adult female crossing the road is a pretty large sight to see," the officer told reporters at the scene, noting investigators are looking into what speed the car was travelling and whether distracted driving played a role in the crash.Â
Gluckstein said there's no indication the driver, who remained at the scene and is co-operating with police, was impaired.Â
He said the driver was hospitalized with minor injuries after the crash.Â
Gluckstein said investigators are exploring possible charges as they continue to speak with witnesses and look to pull surveillance camera footage from residents in the area.
He urged drivers to slow down, obey the rules of the road and be aware of their surroundings.

The number of people using food banks continues to rise in Quebec
A new report says the demand at Quebec food banks is continuing to break records.
The 2026 Hunger Count report was published by Food Banks of Quebec.
It says the food banks are now fulfilling 3.27 million requests each month.
But close to 14 per cent of the network's 1,400 community organizations say they had to turn people away because of food shortages.
The report adds that 70 per cent of organizations say they faced a shortage in the last year.
The report says the situation has been deteriorating since the pandemic.
“Needs remain at a historically high level,” Food Banks of Quebec Executive Director Alexandre Lebel told The Canadian Press. “There are far too many people who still have to rely on food assistance.”
Among the households assisted in 2026, nearly a quarter derive most of their income from a job, shows the report.
“Having a job doesn’t necessarily protect you from food insecurity,” says Lebel.Â
Chantal Vézina, executive director of Moisson Montréal, says that inflation is making it harder for households to get out of difficult financial situations.
“Unfortunately, food is a discretionary expense, and people will do whatever it takes, of course, to avoid ending up on the street," she says.
Children account for around one-third of recipients in food banks, says Lebel.Â
