Toronto cyclists ask Canada's top court to weigh in on Ford's bike lane removal plan
Cyclists challenging Ontario's plan to remove major Toronto bike lanes are asking Canada's top court to hear their appeal.
The cyclists said today they will seek leave to appeal to the Supreme Court of Canada, the same day as Ontario said it would start taking out more bike lanes along parts of Bloor Street West.
A lower court initially ruled the province's plan to replace 19 kilometres of bike lanes with car lanes on three major roads was an unconstitutional risk to cyclist safety.
But the Ontario Court of Appeal overturned that decision in an August ruling that said the trial judge had improperly strayed into policy-making and political considerations.
Anyone who receives a judgment from a top provincial or territorial court can ask the Supreme Court to consider their case.
The Supreme Court only hears a fraction of those cases, which typically must involve a key constitutional question, conflicting lower court decisions or a new issue of law.

Quebec author admits past plagiarism, denies AI use in novel
Quebec author Thélyson Orélien is admitting he plagiarized other writers in his earlier work, but maintains he didn't use artificial intelligence to write his acclaimed novel.
In a statement released by his publisher, Éditions du Boréal, Orélien apologized for making what he described as unacceptable mistakes in his youth.
He also rejected allegations that his novel, C’était ça ou mourir, was written using AI.
Orélien says he began writing the novel in 2017 and finished writing the first draft in 2019.
He says no sentence in the book was generated by a machine.
The statement comes after allegations surfaced in October about the novel’s possible use of AI and plagiarism in Orélien’s earlier writings.
The prestigious French literature prize, the Académie Goncourt, subsequently removed the novel from its selection while Boréal suspended promotional activities surrounding the book.

Key figure in Pearson airport gold heist testifying at trial of another accused man
A man who admitted his role in the massive gold heist at Toronto's Pearson airport is testifying today at the trial of another man accused in the case.
Arsalan Chaudhary was sentenced this spring to four years in prison after pleading guilty to theft over $5,000, and he was given 40 years to pay back $22 million in restitution.
He is taking the stand in the trial of Parmpal Sidhu, who has pleaded not guilty to charges of theft over $5,000 and conspiracy to commit an indictable offence in the 2023 heist.
Prosecutors allege that Sidhu, an Air Canada employee at the time, provided a doctored waybill that allowed another man to pick up more than $22 million in gold and currency from a Pearson airport cargo bay in what investigators have called one of the largest gold heists in Canadian history.
Peel regional police have said 6,600 gold bars weighing more than 400 kilograms were stolen from the airport on April 17, 2023.
Sidhu's trial is taking place in Brampton, Ont.
